Privacy Policy and Terms of Use
1 - Definitions
For the purposes of this Privacy Policy, the following definitions apply:
Cookies: Files sent by the Portal's server to the Visitors' computers to identify the computer and obtain access data, such as browsed pages or clicked links, thus allowing the customization of the Visitors' navigation on the Portal according to their profile.
PWRD BY COFFEE: The name used in this document to identify the controller and owner of this Portal, MANUFATURA POWERED BY COFFEE LTDA, registered under CNPJ nº 44.949.981/0001-93, with headquarters in the city of Espírito Santo do Pinhal, ESTS JAYME LEME, Nº0, Distrito Industrial.
IP: Abbreviation for Internet Protocol. It is a set of numbers that identifies the visitors' computers on the Internet.
Logs: Records of activities carried out by the Visitors on the Portal.
Portal: Refers to the electronic address http://www.pwrdbycoffeeusa.com and its subdomains.
Visitor: Any person browsing the Portal.
User: Visitors who are authenticated in the Portal system.
Web beacons: Programming lines in HTML pages that aim to obtain details of the user's navigation, such as how long the site was open, which address was visited next, among others.
2 - Data and Information Collection
2.1 - Data and information will be collected when Visitors interact with various features on the Portal, voluntarily providing information, such as in the "Customer Service" section, for example.
3 - Data and Information Storage
3.1 - All data and information collected from Visitors will be incorporated into the Portal's database, which is managed by PWRD BY COFFEE.
3.2 - The collected data and information will be stored in a secure environment, following the state of the art, and can only be accessed by qualified and authorized personnel from PWRD BY COFFEE.
3.3 - Considering that no security system is absolutely secure, PWRD BY COFFEE disclaims any liability for any damages and/or losses resulting from database failures, viruses, or invasions of the Portal, except in cases of intentional misconduct or negligence by PWRD BY COFFEE.
3.4 - PWRD BY COFFEE only collects the information necessary to conduct its business, which is Clothing and Apparel.
4 - Use of Data and Information
4.1 - The data and information collected from Visitors may be used for the following purposes:
a) Responding to any questions and requests from Visitors;
b) Compliance with legal or judicial orders;
c) Establish, defend, or regularly exercise rights in legal or administrative proceedings;
d) Prepare general statistics to identify the profile of Visitors and develop PWRD BY COFFEE campaigns, without personal identification;
e) Ensure the security of Visitors;
f) Keep Visitors' registrations up to date for contact purposes via telephone, email, SMS, direct mail, or other communication means;
g) Inform about news, promotions, and events from PWRD BY COFFEE and its commercial partners.
4.2 - The database collected by the PWRD BY COFFEE Portal will not be shared, sold, assigned, transferred, informed, or rented to third parties.
4.3 - The acquired data can only be accessed by professionals duly authorized by PWRD BY COFFEE, respecting the necessity to which they will be subjected, the relevance to the Portal's objectives, and the users' interests, in addition to preserving the users' privacy.
4.4 - If the User stops using the services offered by the Portal, PWRD BY COFFEE may, for auditing and rights preservation purposes, retain the record of their data and information for a maximum period of 5 (five) years, with the option to delete them definitively at its discretion.
5 - Cookies
5.1 - The Portal may use cookies, and Visitors can configure their Internet browser to block them if they wish. In this case, some Portal functionalities may be limited.
5.2 - The Portal may use web beacons to collect data on visitors' behavior on the pages, without the need to install files on visitors' equipment.
5.3 - Other technologies may be used to obtain users' navigation data, but they will always respect the terms of this policy and the user's choices regarding their collection and storage.
6 - General Provisions
6.1 - The provisions of this Privacy Policy may be updated or modified at any time, and Visitors are responsible for checking it whenever they access the Portal.
6.2 - Visitors should contact us if they have any questions regarding the provisions of this Privacy Policy through the "Customer Service" section.
6.3 - The user, by providing information in a public area of the PWRD BY COFFEE Portal, is aware that it will be available to other Visitors and Users of the site.
6.4 - PWRD BY COFFEE cannot control what Visitors and Users do with the information published on the site. Remember that any information disclosed in these areas can become public information, and therefore, caution and good judgment are important when publishing any content.
7 - Applicable Law and Jurisdiction
7.1 - This Privacy Policy will be interpreted according to Brazilian law, in the Portuguese language, with the court of PWRD BY COFFEE's jurisdiction in the state of São Paulo being chosen to resolve any litigation, issue, or doubt, with express waiver of any other jurisdiction, no matter how privileged it may be.
